These Terms & Services (“Terms”) govern your access to and use of Estativo.com (the “Website”) and all related digital products and services provided by Estativo, including our mobile application and any future web or desktop applications (collectively, the “Services”).

By accessing the Website or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Website or Services.

1. Nature of the Services

Estativo provides a digital software platform intended for use by real estate agencies and real estate professionals.

Estativo is not a real estate broker, agent, legal advisor, financial advisor, or valuation authority. We do not participate in real estate transactions, negotiations, or decision-making. The Services are provided strictly as a technology solution.

2. Eligibility

The Services are intended for business and professional use only. By using the Services, you confirm that:

  • You are at least 18 years old

  • You have authority to bind your business or organization (if applicable)

  • You will use the Services in compliance with applicable laws

3. Accounts and Access

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activity that occurs under your account

  • Providing accurate and up-to-date information

We reserve the right to suspend or terminate access if we reasonably believe there is misuse, abuse, or violation of these Terms.

4. Fees, Payments, and Billing

Certain Services are offered on a paid, high-ticket basis.

  • Fees, billing cycles, and payment terms will be communicated prior to purchase

  • All payments are non-refundable unless explicitly stated otherwise in writing

  • Invoices, payment confirmations, and billing inquiries are handled via finance@estativo.com

Failure to pay applicable fees may result in suspension or termination of access.

5. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes

  • Reverse engineer, copy, scrape, or exploit the platform

  • Interfere with system security or performance

  • Use the Services to distribute harmful, misleading, or unauthorized content

  • Circumvent usage limits or access controls

We reserve the right to investigate and take action against violations.

6. Intellectual Property

All content, software, branding, designs, and materials associated with Estativo are owned by or licensed to Estativo and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable right to use the Services during the term of your agreement.

No rights are granted except as expressly stated.

7. Data and User Content

You retain ownership of any data or content you submit to the Services.

By using the Services, you grant Estativo a limited right to process such data solely for the purpose of providing and improving the Services, in accordance with our Privacy Policy.

8. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Estativo disclaims all warranties, whether express or implied, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Accuracy or completeness of results

We do not guarantee uninterrupted, error-free, or secure operation.

9. Limitation of Liability

To the maximum extent permitted by law, Estativo shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of profits, revenue, data, or business opportunities

  • Claims arising from third-party services or integrations

Our total liability shall not exceed the amount paid by you to Estativo in the preceding twelve (12) months.

10. Indemnification

You agree to indemnify and hold harmless Estativo from any claims, damages, losses, or expenses arising from:

  • Your use of the Services

  • Your violation of these Terms

  • Your violation of applicable laws or third-party rights

11. Termination

We may suspend or terminate access to the Services at our discretion, with or without notice, if:

  • These Terms are violated

  • Required by law

  • Continued operation poses legal or security risk

Upon termination, your right to use the Services ceases immediately.

12. Modifications to the Services and Terms

We reserve the right to modify or discontinue the Services, or to update these Terms, at any time.

Updated Terms will be posted on the Website. Continued use constitutes acceptance.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
